Call of Duty lawsuit dismissed due to lawyer not playing Infinite War

The Call of Duty lawsuit was dismissed after it was determined that the attorney in the case had not actually played the game. Call of Duty is one of the biggest franchises out there, making billions of dollars every year. Like any other successful franchise, there is a group of people who want a piece of the pie, whether they qualify for it or not. Recently, wrestler Booker T lost a lawsuit to Activision claiming that Black Ops character David ‘Prophet’ Wilkes was modeled after GI Bro, a character created by Booker T.

one of the Latest lawsuits Brooks Entertainment, Inc. in November 2021. The company specializes in film and television production as well as other forms of media such as two games known as Save one bank And the stock picker. Brooks Entertainment claimed that Activision’s Call of Duty: Infinity War Many similarities emerged with the above projects from Brooks Entertainment such as a stationary piece in a mall and even naming the game’s protagonist, Sean Brooks, who was dependent on the company’s CEO. Most of this is incorrect or exaggerated because Brooks is not the main character and the mall takes place in the distant future without Brooks. Activision sent a letter to Brooks Entertainment’s attorneys asking them to withdraw the lawsuit, stating that their complaint contained “serious factual misrepresentations and errors, and the allegations therein are factually and legally false.” After Activision filed requests for penalties in March, the Southern California District Court dismissed the case with bias in July and indicated that the plaintiff’s attorney could have verified those facts by playing for one hour. Call of Duty: Infinity War

Call of Duty: Infinite War It is a first-person shooter, not a first-person and third-person shooter as allegedly, and Shawn Brooks does not direct a scripted battle scene in a high-fashion mall,” the court said in its ruling in favor of Activision. The lawyer could have easily verified these facts before filing the groundless complaint, just as the court easily verified them within the first hour and a half of playing the game.”

The plaintiff’s attorney was ordered to pay Activision a fee for the time and money it spent on the case. It’s a rather strange case and it seems like it was an easy win. As it stands, Brooks Entertainment will not be able to reconsider in that court. Activision’s next entry in the FPS franchise, Call of Duty: Modern Warfare IIIt will be released on October 28, 2022.
